POPI Statement

Introduction

The following statement is in terms of the Protection of Personal Information Act, 2013 (“POPI”) and governs your interactions and business dealings with sparrowhawk.cloud, trading as Sparrowhawk IT Services (Pty) Ltd, hereafter referred to as sparrowhawk.cloud.

“Third Parties” include, but are not limited to, operators, affiliated companies, suppliers, and parties providing products, goods, equipment, systems, and services directly related to fulfilling services for an order the client has requested.

“Personal Information” means any information or set of information that identifies a person and is processed by or on behalf of sparrowhawk.cloud, as described in Chapter 1, Section 1 of POPIA.


Processing of Client Personal Information

sparrowhawk.cloud will only process a client's Personal Information in adherence to POPIA:

  • To the extent that consent is given by each client.
  • Where necessary to perform an action for the fulfillment of an order placed by the client.
  • As part of an obligation imposed by law on sparrowhawk.cloud.
  • To protect a legitimate interest of the client.
  • Where necessary for pursuing the legitimate interests of sparrowhawk.cloud.

Personal Information & Third Parties

sparrowhawk.cloud may provide Personal Information to Third Parties where:

  • It is required in the course of, and for the purpose of, carrying out sparrowhawk.cloud’s business activities with its clients.
  • It is in accordance with what is outlined above, in its client agreements, service terms, or service level agreements.
  • It is required by law.

sparrowhawk.cloud will undertake reasonable steps to ensure that client Personal Information transferred to Third Parties is handled confidentially and in compliance with applicable legal requirements.

sparrowhawk.cloud shall only transfer Personal Information to Third Parties in other jurisdictions where such parties are subject to and comply with laws, policies, or agreements regarding privacy, data protection, and confidentiality of Personal Information, such as but not limited to POPIA or GDPR.


sparrowhawk.cloud as a Third Party

In the course of conducting its business as an IT services and hosting provider, sparrowhawk.cloud may collect Third Parties’ Personal Information from time to time. sparrowhawk.cloud will process the Personal Information received from clients on behalf of the client’s data subjects in conjunction with its Client Agreement, Service Terms, and applicable legal requirements. sparrowhawk.cloud will ensure that in processing or storing a Third Party’s Personal Information, it adheres to its obligations in terms of POPIA.
